Requirements

The following information must be submitted to the Intellectual Property Corporation of Malaysia in order to receive the filing date

  • the applicant’s details
  • the trademark representation
  • The inventory of products or services.

In Malaysia, the Power of Attorney is not necessary for the registration of a trademark.

In the event that convention priority is asserted, it is necessary to submit a certified copy of the Priority Document, along with a certified English translation in cases where the documents are not in English, no later than thirty days from the date of trademark application filing.

Trademark Renewal

Within two months of the Notice of Invitation for Publication, the official grant fee must be paid. In Malaysia, a trademark registration is valid for ten years following the filing date. Every ten years, the Malaysian trademark is up for renewal. The late renewal charge must be paid within one month of the previous registration’s expiration date if the renewal fee is not paid by the deadline

Duration

In Malaysia, the typical processing period from filing to trademark registration is between 12 and 18 months.
