Mozambique trademark applications can be submitted via the ARIPO union, wherein the applicant can submit a solitary application that identifies the particular contracting states. This can be done directly at ARIPO or via a contracting state.

Requirements

A local agent must submit a trademark application to the Industrial Property Institute (IPI) in Maputo. A power of attorney, notarized in front of a notary public, with ten copies and a Portuguese translation included, with the exception of word marks in regular font. primary paper (if any), translated into Portuguese with accuracy. A domestic registration is not required for foreign candidates.

Procedure

A formal assessment, a distinctiveness examination, and a trademark search are all part of the application procedure. The entire process, from initial file to registration, takes 16 to 22 months. The trademark is published in the twice-monthly “Boletim da Propriedade Industrial” after it has been registered. It is NOT feasible to prolong the opposition period.

Duration

In Mozambique, a trademark registration is effective from the date of filing and is valid for ten years. Ten-year renewal periods are available for the registration.
