Requirements

The laws of Kazakhstan provide that trademarks that are identical to or similar to those that have already been registered or applied for registration in relation to similar goods and/or services are not eligible for registration.

To find out if any submitted trademark applications or registered trademarks that are identical or similar to your mark could be objected to at the examination stage.

Documents

  • Trademark prints; the applicant’s name and address;
  • A list of products and/or services classified under the Nice System.
  • If priority is to be claimed, certified copies of the relevant documentation may be submitted to the Kazakh Trademark Office within two months of the filing date.
  • Power of Attorney, signed and stamped; if stamp is not available, POA needs to be notarized. 
  • Legalisation is not necessary; applications may be submitted to the Kazakh Trademark Office up to two months after the date of filing.

Trademark Registration Procedure

After filing, the Kazakh trademark application is subject to a preliminary examination that takes one to two months. The application proceeds to substantive examination, which is completed in approximately seven months, if it satisfies filing requirements. A matching notification is then sent out. The decision to register a trademark is made only if it satisfies the protectability standards; thus, the Trademark Office must receive the official registration fee. Upon receipt of the official fee, the certificate of registration is granted approximately one month later. A provisional rejection of trademark registration is given in the event that the substantive examination reveals any barriers to registration; this refusal may be appealed within a further three months. In Kazakhstan, registering a trademark is a straightforward process that takes about nine months.
